Risk Management Policy Enforcement Schedule

 

The following is a description of the levels of policy violations and suggested sanctions. Any violation of the Risk Management Policy is viewed seriously, and it is the responsibility of each fraternity entity and member alumnus to see that the Risk Management Policy is upheld, and equally importantly, that the spirit of the Policy is met. While each infraction shall be judged on its own facts and the Board of Governors reserves the right to amend sanctions to fit the particulars of any case, the following shall be the default sanctions issued by the Fraternity.

LEVEL I VIOLATION

  • Any violation by a fraternity entity, or by any member purporting to act on behalf of that entity, of any host-institution social, risk management or similar policy not involving alcohol, illegal drugs, hazing, sexual assault, harassment, or fighting.
  • A violation of a house/facility management policy, law or regulation.
  •  

STANDARD SANCTION: Ratification and endorsement of host-institution/legal authority sanctions (if any) and any other sanction(s) against chapter and/or members that the Board of Governors feels appropriate under the circumstances.

LEVEL II VIOLATION

  • Any violation(s) by a fraternity entity, or by any members purporting to act on behalf of that entity, of the Fraternity's risk management policy related to one specific incident.
  • A repeat violation of the same Level I violation the same insurance cycle.
  • A Level I violation which results in substantial injury.
  • Violations of sanctions imposed as a result of a Level I violation.

STANDARD SANCTION: Ratification and endorsement of host-institution/legal authority sanctions (if any); imposition of an insurance surcharge of 10% for the chapter's next insurance cycle; case-specific sanction against the chapter and/or individual member(s); other sanctions as deemed appropriate by the Board of Governors up to and including suspension or charter ("closing” the chapter.”)

LEVEL III VIOLATION

  • A third violation of the same Level I violation during the same insurance cycle.
  • A second Level II violation of any type during the same insurance cycle.
  • Organized deception to circumvent the Risk Management Policy.
  • Organized deception to interfere with, hinder or delay an investigation by the Fraternity into any Level I, II or III violation.

STANDARD SANCTION: Ratification and endorsement of host-institution/legal authority sanctions (if any); imposition of an insurance surcharge of 30% for the chapter's next insurance cycle; case-specific sanction against the chapter and/or individual member(s); other sanctions as deemed appropriate by the Board of Governors up to and including suspension of charter ("closing” the chapter.”)

REPORTING VIOLATIONS

Any report regarding a potentially claimable incident which is first filed more than 72 hours but less than 30 days from the time of such incident shall result in a 30% surcharge being imposed on that entity for the next insurance cycle. Any such report first filed more than 30 but less than 60 days from the time of such incident shall result in a 50% surcharge being imposed on that entity for the next insurance cycle. First reports filed more than 60 days after an incident will result in coverage being denied to the entity/entities failing to make its/their report(s).
